Andersen Manufacturing initially filed this action against Wyers Products Group in the District of Idaho alleging infringement of three patents – U.S. 6908099, U.S. 7156412 and U.S. 7222510. However, after the Supreme Court’s decision in TC Heartland LLC v. Kraft Foods Group Brands LLC, 137 S.Ct. 1514 (2017) came out – holding that venue is proper where the corporate defendant is incorporated and not where it did business – Wyers requested that the case be transferred to District of Colorado. The motion was granted and the case has been transferred to Colorado.
Plaintiff is represented by Michael K. Friedland and Lauren Keller Katzenellenbogenog of Knobbe Martens, Olson and Bear LLP, Irvine, California. Defendant is represented by Ralph M. Martin of Patent Law Offices of Rick Martin, P.C., Longmont, Colorado.
